Definitions
"Auctioned Individual" means the person who puts themselves on the Website(s) to allow others to place a bid for them.
"Bidder" means the individual placing a bid for the Auctioned Individual.
1.1 If the Auctioned Individual has listed their profile on auction as ‘For Highest Bidder Wins’, then when the auction time expires, the winning Bidder must pay the highest Bid sum within 14 days.
1.2 If the Auctioned Individual has set their auction for "I will choose" and they choose any Bidder other than the highest Bidder, the chosen Bidder can decide whether they want to pay or not as they were not the highest bidder. If the chosen Bidder decides to pay, the same rules and procedures will apply as though they were the highest Bidder.
2. Payment by Bidder
2.1 If the Bidder does not pay within 14 days of the expiration of the auction time they will receive a negative feedback from BidBuyDate. The Bidder can remove this feedback by paying for the auction they have won within 14 days of the posting of the negative feedback.
2.2 If the highest or chosen Bidder pays within 28 days of the expiration of the auction time they can leave negative feedback for the Auctioned Individual in the event that the Auctioned Individual does not turn up. But the Auctioned Individual cannot leave any Feedback in return because the Secret "Date Code" will not have been exchanged.
3. Meeting
3.1 Once the Bidder has paid, the Bidder and Auctioned Individual have 30 days from the date of full payment in which to meet.
3.2 As soon as the winning Bidder pays they will be sent an 8 digit numeric Secret "Date Code" by BidBuyDate to their email address and/or to their registered messaging service via SMS.
3.3 Once the Bidder and Auctioned Individual meet, the Bidder will hand the "Date Code" to the Auctioned Individual, and the Auctioned Individual can then sign into their BidBuyDate account and submit the "Date Code" to a designated webpage, or text the "Date Code" to BidBuyDate via SMS from the Auctioned Individual’s pre-registered mobile phone. At this stage the "Date Code" will be deemed exchanged.
3.4 The Auctioned Individual will receive a reply from BidBuyDate via SMS or email. The Auctioned Individual may then sign into their BidBuyDate account and check for any feedback response. The Auctioned Individual may submit feedback on the Bidder. At this point 50% of the successful bid will be credited to the Auctioned Individual’s account. If the Auctioned Individual fails to provide their feedback on the Bidder they will not receive any payment.
3.5 If the Auctioned Individual leaves the Bidder positive feedback, the Bidder will receive an email and text via SMS informing them that they have received positive feedback. In order for the Bidder, and other BidBuyDate members, to view the feedback, the Bidder will then be required to provide their feedback on the Auctioned Individual. Please note that if the Bidder provides a negative feedback for the Auctioned Individual the positive feedback they have obtained will not be displayed. If both Bidder and Auctioned Individual provide positive feedback this will be displayed on the BidBuyDate website(s) for members to see.
3.6 If the Auctioned Individual leaves positive feedback but the Bidder leaves negative feedback for the Auctioned Individual, the positive feedback provided by the Auctioned Individual for the Bidder will not be shown to BidBuyDate members. Once the Auctioned Individual has left the Bidder with positive feedback, the Bidder has a period of 30 days on their "won" page to leave feedback on the Auctioned Individual. If the Bidder fails to provide this feedback within the 30 day period, the positive feedback left by the Auctioned Individual for the Bidder will not be displayed. If the Auctioned Individual leaves the Bidder negative feedback this will be shown straight away to BidBuyDate members, after which the Bidder may leave their feedback in reply.
3.7 If the Auctioned Individual does not turn up the Bidder can request a refund (subject to the terms below) after the 30 days meet up period has expired
4. Eligibility for a Refund
4.1 In order for the Bidders’ refund request to be accepted by BidBuyDate the secret "Date Code" must not have been exchanged and the Bidder must have posted a negative feedback for the Auctioned Individual.
4.2 The Bidder has a period of 21 days from the end of the 30 day meet up period to post negative feedback. If the Bidder provides such negative feedback within the negative feedback period, they will be refunded the Bid sum by BidBuyDate (within a reasonable period of time) less a 20% administration charge.
4.3 If the Bidder notified a failure to meet and seeks a refund but fails to provide the Auctioned Individual with a negative feedback within the negative feedback period, BidBuyDate will refund the Bidder 50% of their paid bid sum, and BidBuyDate reserves the right to post negative feedback on the Bidder.
4.4 If the Bidder pays but no "Date Code" has been exchanged and no refund request is made, BidBuyDate will refund the total sum back to the Bidder (within a period of 3 months from the date of payment), less 50% and will post negative feedback on the Bidder.
5. BidBuyDate Approval
All feedback, photos, videos, usernames, introduction titles, introduction descriptions, professions, must be approved from our administrators before being posted on the Website(s). BidBuyDate reserves the right to edit or not display any feedback for any reason, no reasons are required to be given to the person giving feedback for the failure to display the feedback.
